By using our website or submitting an order to MakeMyFreshener.com, you (also referred to below as the customer) are hereby agreeing to all the Terms and Conditions as set forth below. This agreement is in lieu of a written consent, and will be binding by the both the customer and/or their representative(s).
We market and sell our products, for purchase by adults. You agree that you are at least 18 years old or have the consent of a parent or legal guardian, and are fully able and competent to enter into the Terms and Conditions of this website. If you are under age 13, we ask that you do not submit any personal information to us. Please ask a parent or guardian to assist you.
MakeMyFreshener.com grants you permission to access and make use of this site for creating or purchasing air fresheners from this website. Except as expressly permitted in these Terms and Conditions, all content included on this site is the property of MakeMyFreshener.com, or its content suppliers or licensors and is protected by U.S. and international copyright laws. You may not copy, modify, publish, transmit, transfer sell, reproduce, create derivative works from, distribute, display, incorporate into another website, apply the art and designs on any products or in any other way exploit any of the content of this website, in whole or in part without the specific permission of MakeMyFreshener.com. This prohibition includes, the use of any proprietary characters by contributing artists, or in any media.
You agree to not use MakeMyFreshener.com to upload, e-mail, post, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable or that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
Do not hang air fresheners where they will obstruct your view or be a distraction. Some states or countries may restrict the use of hanging air fresheners on rear-view mirrors. It is your responsibility to know the laws of the state or country.
All orders must be processed online. Payment is due in full prior to commencement of production. Credit card authorization and address verification must be received prior to processing the order form.
When placing an online order, if you press 'SUBMIT' more than once, your card may be charged again. Once you inform us of any such duplicate charges, we will promptly credit the amount back to you, however, we will not accept any responsibility for any subsequent bank fees that may be imposed upon you due to these duplicate charges.
You will receive an order confirmation/Sales invoice via email shortly after an order is placed and payment confirmed.
Check your spam or deleted folders to ensure that these important emails are not blocked due to firewalls or spam filters on your computer.*
MakeMyFreshener.com begins production on incoming orders once they are confirmed. Therefore, we are not able accept any order cancellation requests.
A repeat order (or "re-order") may not bear the exact colors as in the "original" order. This is due to several factors relevant to the inconsistency of raw materials, mixing of printing colors paper absorption and/or fragrance.
We pride ourselves on making an outstanding product that can be viewed and enjoyed by many people. MakeMyFreshener.com reserves the right to immediately terminate any order for any reason without notice to you in its sole discretion.
Please follow instructions located in the Design Center carefully to ensure a successful upload of your art. In addition, please review information found in the “Guidelines” page. For best results use photos from a digital camera (cell phone photos produce a lower quality image), upload your art and photos at 150 to 300 dpi as a jpeg with a maximum size of 2 megs. Due to the absorbent nature of the paper, ink colors come out slightly lighter, so well-lit photos and distinct images work better. Higher quality photos produce better results. Client warrants that client is either the sole creator of all specifications and images or that client has license to use all specifications and images provided to MakeMyFreshener.com. Client further warrants that the specifications and images do not infringe upon any statutory copyright, common law right, trademark, proprietary right, or any other right.* Client in furnishing specifications to MakeMyFreshener.com, agrees to hold MakeMyFreshener.com, harmless against any and all claims by way of infringements or the like that arise out of compliance with the specifications and/or art.
Due to "finite" imprint areas, we reserve the right to resize your image in order to fit it into the imprint area; regardless of what size you submit.
Imprint colors must be carefully chosen. We recommend that you choose light colors to be printed onto dark colors, as this provides more contrast than a dark colored imprint on a dark colored item or a light colored imprint on a light colored. However, many customers have their own pre-conceived notions about what looks good and what does not, therefore, we will NOT judge your options NOR will we be responsible for the choice of imprint color(s) that you make.We try to match your color selections as closely as possible. An exact match cannot be guaranteed. Note that the imprint color may change due to the absorption of the materials, inks and fragrance. Consider color variations and effects when selecting colors. Printing the color black onto a navy or dark green may result in a hard-to-see imprint, as dark on dark does not stand out. In order to promote the best visibility of your custom logo/text, we strongly recommend that you print light colors onto a dark surface and dark colors onto a light surface. MakeMyFreshener.com does not guarantee color or die cuts on orders.
Fragrance longevity varies according to the environment in which the air freshener is placed as well as the individual properties of a fragrance.
Air Fresheners once removed from the cellophane wrapper must be hung freely and not placed in contact with surrounding materials such as painted surfaces, plastic, leather, fabric, wood and all other materials. CONTACT WITH SUCH SURFACES WILL RESULT IN DAMAGE. MakeMyFreshener.com is not responsible for any damages caused by any use of its fresheners. Place air fresheners in areas that do not block your vision. Insure that strings are tied securely, hung with care, and are mounted securely to prevent air freshener from touching all surrounding surfaces, hang freely. Place in areas where a fallen air freshener will not damage the surrounding surfaces.
You have a choice of turnaround timelines. Your choice should reflect your "ship by" date, and we will do our utmost to stay within the given time frame. Please note that we are not responsible for late receipt of any order due to any unforeseeable circumstances including production issues, supplier shortages, weather-related issues, any circumstances beyond our control or delays on behalf of the shipping company.
The "estimated' normal production time is 10 business* days after receipt of order. However this may vary. If you have a specific "in-hands" date, please ensure that there is adequate time before you opt for a "normal production" timeline. All production timelines reflect business days and may change without notice.
We offer a 24 Hour Rush (production time only) service as well as several other rush (production time only) services when it is feasible. Production time does not include any shipping time; therefore shipping time must also be added to production time in order to get an accurate delivery time frame. There is an additional fee for this service.
Note that ship dates are only "estimated" and not "guaranteed" for orders with normal production timelines. If you opt for "expedited" shipping method for your "normal production" order, keep in mind the production timeline is still only "estimated". Therefore the order may still not reach you in the timeline required. Rush Ship Date Production time is guaranteed on rush orders. It is the shipping company's responsibility to deliver on-time, and we do not guarantee the shipping company's delivery time.
When you place a rush order but then opt for "normal" or "ground" shipping method, please be advised that the ship date will be met by us, however we do not guarantee the delivery date as shipping companies do not offer guarantees for ground shipping or residential service.
However, if you opt for "expedited" shipping, the delivery date will be guaranteed by the shipping company, so the order will reach you in the timeline required. MakeMyFreshener.com is not responsible for any delivery problems or negligence by the shipping company or its affiliates.
If we fail to meet a promised delivery date on a 24hr rush order with expedited shipping, but you will still accept the order, then a credit will be promptly issued for the difference between the 24hr (per piece) price and the next available rush option (per piece) price. If we fail to meet a promised delivery date on a 1 week rush order with expedited shipping, but you will still accept the order, then credit will be promptly issued for the difference between the 1 week rush (per piece) price and the normal production (per piece) price. Normal production orders with estimated delivery dates are not guaranteed.*Please note that once you submit your order, any changes, will void our guarantee policy.
MakeMyFreshener.com is not responsible for lost or stolen packages.
Once the order has left the warehouse, MakeMyFreshener.com will not accept responsibility for any delays caused by the shipping company. MakeMyFreshener.com will not be held responsible either in the event the customer is not available for delivery or the customer refuses delivery.
For orders shipping outside the U.S. - including Canada, local duties and/or taxes may be assessed upon delivery. These fees are not charged by MakeMyFreshener.com during checkout; therefore please consult your local customs office to determine these charges. We are not responsible for these duties and/or taxes. Note that delivery dates outside of the U.S. are essentially "estimates", and in noevent will MakeMyFreshener.com be liable for any consequential damages arising from delays in delivery.
We print our air fresheners on paper which is produced to absorb fragrance. This also creates slight inconsistencies in the deposit of inks. Therefore, the surface is porous and photos, images, designs and art printed on this surface produce a lower resolution.
The design you see on the computer screen represents the art, but does not show how the finished product will look once printed on the air freshener paper. Due to the natural properties of the material and the production process, photo colors and line weight may vary. Slight variations and imperfections in the raw materials may result in possible changes to size, shape, color, marks, etc. These conditions are within acceptable industry standards and are not considered flaws.
MakeMyFreshener.com may establish practices and restrictions concerning use of the website, including without limitation the maximum number of days that email messages or other uploaded content will be retained by the website, the maximum number of email messages that may be sent from or received by an account on the website, the maximum size of any email message that may be sent from or received by an account on the website, the maximum disk space that will be allotted on our servers on your behalf, and the maximum number of times and the duration that you may access the website in a given period of time. Your use of this website constitutes your consent to allow MakeMyFreshener.com to store electronic communications on its servers.
You agree that MakeMyFreshener.com has no responsibility or liability for the deletion or failure to store any messages and other communications or other content maintained or transmitted by the website. You further acknowledge that MakeMyFreshener.com reserves the right to modify these practices and restrictions from time to time.
MakeMyFreshener.com does not warrant that information, graphic depictions, product and service descriptions or other content of the website is accurate, complete, reliable, updated, current or error-free.
In all circumstances, MakeMyFreshener.com's maximum liability is limited to the purchase price of the products sold. MakeMyFreshener.com will not, under any circumstance, be held liable for any claim or action that exceeds this liability limit.
MakeMyFreshener.com will not be liable for any direct or third party claims for damages against the customer, nor for malfunction or, misuse of the product, cause of delays, interruption of service, or loss of business.
MakeMyFreshener.com's failure to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision. If any provision of these terms shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the terms and shall not affect the validity and enforceability of any remaining provisions.
These terms shall be governed and construed in accordance with the laws of the state of Ohio applicable to agreements made and to be performed in Ohio. You agree that any legal action or proceeding between MakeMyFreshener.com and you for any purpose concerning these terms or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Ohio. Neither the course of conduct and/or course of dealing between the parties nor trade practice shall act to modify any provision of this agreement.
MakeMyFreshener.com may assign its rights and duties under this agreement to any party at any time without notice to you. Your rights and duties under these terms are not assignable by you without written consent of MakeMyFreshener.com. These terms do not provide any third party with a remedy, claim, or right of reimbursement. You must file any claim or suit related to our website within one year after it arises.
It is agreed and understood that we are accountable to collect Ohio state sales tax at a rate of 7.25%. If your order is shipped within the state of Ohio, it will be charged accordingly.
MakeMyFreshener.com reserves the right to change, modify or discontinue the website or any portion of without notice. MakeMyFreshener.com may modify or change the Terms and Conditions without notice other than posting the changes to the website. The terms will take effect when posted, and your continued use shall represent your consent to the changes. You agree that MakeMyFreshener.com shall not be liable to you or to any third party for any modification, suspension or discontinuance of the website.
